The Agreement

The Agreement Below, we set out the main terms and conditions for your holiday rental. The agreement is set out to clarify our obligations to you, your obligations to us, and in the very unlikely event of any disputes, we will use this document as a basis for any resolution. Please read it carefully before confirming your booking and ensure that it conforms to your understanding of what you expect from the holiday rental.

Essential Definitions “Rental Period” The period begins at 16:00 on the agreed start date of the booking and ends at 10.00 on the agreed final date.

“We” or “Us”: Sheena Salah & John Crook

“You”: The person named on the booking form who will take singular responsibility for the entire group for the entire Rental Period.

“The Property”: The property you have agreed to rent.

The Understanding

What we offer

1. We will provide a clean, well maintained holiday property suitable for your party.

2. Specifically, within the Property:

  • Bedding and towels will be of good quality and freshly laundered.
  • Kitchen items supplied will be good quality and be serviceable. All electrical items will be in safe working order.
  • The property will be well stocked with sufficient crockery, cutlery, glasses and cooking appliances in good condition.
  • The pool & hot tub will be professionally maintained, and sufficient additional outdoor furniture will be made available for the available occupancy.

3. We will ensure that all utilities (including, but not limited to gas, electricity, internet (if applicable), satellite TV, water and phone (if applicable) are connected and that all bill payments are up to date. We will not be liable to You for any defect or stoppage in the supply of public services beyond our control.

4. The property will be available for occupation from 4.00 pm on the start date of the booking until 10.00 am on the final date, unless agreed otherwise in writing.

5. We will ensure a competent maid service as follows: Maid service, including a thorough clean between tenants is included in the Rental price. The maid service is there to keep the property clean and hygienic, but will not normally include making the beds, washing up dishes or any personal laundry. Bed linen and towels will be changed once per week.

6. At any time prior to the commencement of the rental, we will respond to any queries You may have in a timely and professional manner.

7. Once a reservation has been accepted by Us, we will set out clearly and in writing the timetable of payments, the amounts and the dates by which they should be received.

Your part of the deal:

  1. You will pay Us the agreed rental fee as follows: 25% of the total rental fee is payable upon booking. The booking cannot be considered accepted until this is received by Us.
  2. 8 weeks before the start date of the Rental Period, You will pay Us the 75% balance. In addition, you will pay a security deposit of €300. This deposit will be banked by Us and held in accordance with the terms set out in the SECURITY DEPOSIT section below. Delay in any payment will constitute cancellation by You of the booking.
  3. You acknowledge that the Property is a private holiday home which is used frequently by the owners and is maintained to a standard that is considered suitable for personal use. While You occupy the Property, You will be responsible for maintaining the property, furniture, furnishing and equipment in the same state as You find it at the commencement of the Rental Period, and will indemnify Us against any loss or damage caused by Your negligence in excess of the security deposit referred to in Paragraphs 1 to 4 in the security deposit section.
  4. You will without delay report to our local representative any defects in the property or breakdown in the equipment, plant, machinery or appliances in or on the property, and arrangements will be made for repair or replacement as soon as reasonably possible.
  5. You will not exceed the maximum occupancy permissible and only those listed on the booking form can occupy the property. If you wish to invite additional visitors to visit you during your stay, please ask us first. Please be advised that no extra overnight visitors are allowed to stay at the property.
  6. You will allow maintenance personnel, cleaning staff and the Owner’s representative reasonable access to the property for the purposes of repair and maintenance.
  7. You will not smoke inside the Property, and You will ensure that no one else in your group does either.
  8. If damage occurs and the owner must cancel and/or refund subsequent bookings, the owner may bring a claim against you for any loss arising as a result.
  9. Please do not move any furniture from one room to another or any of the indoor furniture, furnishings or bed linen outside.
  10. Please lock the doors and close the windows when you leave the property unoccupied.
  11. Please make sure you switch off lights, heating, air conditioning or any electrical appliances when you go out – we’re an eco-friendly holiday home.
  12. Please don’t take any bath towels with you to the beach, use the beach towels we have provided.
  13. The owner reserves the right to make a charge to cover additional cleaning costs if the client leaves the property in an unacceptable condition.
  14. Please note that if any keys issued are not returned at the end of your stay, then the cost of replacement will be charged to you.
  15. The client may in no circumstance re-let or sublet the property.
  16. The owners shall not be liable to you or your holiday party for loss or damage to property, however arising.
  17. All inventory must remain in the property and not be taken to another property.
  18. You are responsible for the supervision of all members of your party under the age of 18 at all times.
  19. Swimming pool/hot tub: –
  • No children under 18 without adult supervision.
  • Please avoid using glass in the pool/hot tub, use the plastic cups provided.
  • Guests must shower before entering the water and remove suncream and makeup.
  • No diving or jumping in the pool for your own safety as it has a maximum depth of 2.3m.
  • Please replace the hot tub cover after use to retain heat.
  1. Please respect the community and try to keep noise levels to a minimum, especially between 11 pm and 8 am.
  2. We reserve the right to terminate your rental agreement with immediate effect where the unreasonable behaviour of the persons named on the booking (or their guests) may impair the enjoyment, comfort or health of others. You’ll be asked to leave the property, without any refund of the rental amount paid.
  3. Please use the designated barbecue utensils and clean the barbecue after use.
  4. Fireworks, Chinese lanterns, firepits, candles and portable BBQs are prohibited.
  5. Check-out, on departure we would appreciate if you would leave Casa Jóia in a reasonably clean and tidy condition so that it can be efficiently prepared for the next guests. This includes disposing of all rubbish before you leave, the public rubbish disposal point is across the road and 90 metres away in the direction of the village centre.
  6. If you want to use the services of a third-party supplier (e.g. a private chef, beauty treatments) this must be agreed beforehand. If you bring a third-party supplier without consent, we reserve the right to ask them to leave. We do not accept liability for the activities of these third-party suppliers.
  7. Any problem or complaint must be immediately reported directly to us/our representatives to allow us the opportunity to resolve it.
  8. Non-compliance with the house rules will be considered as a breach of the terms and conditions of the rental agreement. We reserve the right to terminate the booking with immediate effect and without a refund if they do not abide by the rules.
  9. This property is privately owned and is our home. We expect all guests to enjoy the facilities and treat the property with the same respect that they would with their own home.
  10. Bookings cannot be accepted from persons under eighteen years of age.
  11. The owner reserves the right to refuse a booking without giving any reason.
  12. We or our representatives reserve the right to enter the property at any time to undertake essential maintenance, repairs or for inspection purposes. Our pool maintenance is carried out on Monday; The gardening team comes on Wednesday mornings.
  13. As your hosts, we are obligated to provide the following information to SEF (Serviço de Estrangeiros e Fronteiras or the Immigration and Borders Service), which comprises the Accommodation Bulletin (SEF):-

The Information we require for each guest: –

  • Full name
  • Date of birth
  • Country of birth
  • Home address
  • Country of residence
  • Nationality
  • Identity document
  • Number of document
  • Issuing country
  • Date of arrival
  • Date of departure

We need the following information, which comprises the SEF FORM:

  • Full name
  • Date of birth
  • Gender
  • Document type
  • Document number
  • Issue date
  • Issue place
  • Expiry date
  • Nationality
  • Home country

This legal requirement in Portugal was introduced in 2015, requiring anyone providing paid holiday accommodation to record the entry, exit, and identification details of all non-Portuguese nationals who use that accommodation.

We need to verify your documentation prior to check-in, so that we can provide the information to SEF promptly upon your arrival. A valid identity document for each non-Portuguese guest, regardless of age (and including children) can be your Passport/identity card or equivalent government-issued photo ID. Who must submit identity documents? So, in order to comply with Portuguese law, we will require a copy of the valid ID for each non-Portuguese person, regardless of age and including children.


(This law has been brought into force in Portugal since the implementation of the 1990 Schengen Agreement that aims to stop human trafficking and other illegal practices).

If the Short-Term Rental where you are staying does not require this information, it means it is not abiding to the law and most likely won’t be able to support you in unexpected situations.

  1. Any problem or complaint must be immediately reported directly to us/our representatives to allow us the opportunity to resolve it.
  2. Non-compliance with the house rules will be considered as a breach of the terms and conditions of the rental agreement. We reserve the right to terminate the booking with immediate effect and without a refund if they do not abide by the rules.
  3. This property is privately owned and is our home. We expect all guests to enjoy the facilities and treat the property with the same respect that they would with their own home.
  4. You can tip the maid at the end of your stay 😊

General terms and Conditions

SECURITY DEPOSIT

  1. When You pay the final instalment, you will also pay Us a security deposit as defined in above. We will bank and hold this against any undue damage or serious loss, or breakage incurred during your stay.
  2. If there are no problems, then we will refund 100% of this deposit to You within 10 days of the end of the Rental Period.
  3. Should we need to retain any of these funds, we will notify You in advance of returning the balance and You will have the opportunity to consider the matter.
  4. The sum reserved by this clause shall not limit your liability to Us in the event of major damage.

CANCELLATION

  1. Bookings made less than sixty days before your arrival date must be paid in full, plus the €300 refundable damage deposit (if requested).
  2. The balance must be paid no later than sixty days before the commencement of your holiday. If the balance is not received by the due date, then your holiday will be treated as a cancellation.
  3. All cancellations must be notified in writing and once received we will confirm the cancellation.
  4. The customer remains liable for a percentage of the booking cost when a cancellation is received, as detailed below: –

We will make best efforts to re-let the Rental Period and any monies received by Us for rentals for this period will be used to make repayment to You. Repayments may be reduced by any out-of-pocket expenses incurred by Us in finding alternative guests, and will include any additional advertising costs, any late booking discount, and any reduction in rentals paid for a shorter booking during this period.

If for any reason the booking is cancelled by Us, all money paid by You to Us including the deposit will be refunded to You immediately.

If we are successful in getting a replacement booking, we will refund the total amount paid less a 5% booking fee and any difference in price between your original and the replacement booking.

  1. All cancellations must be made in writing or by e-mail and once received we will confirm the cancellation.
  2. Where clients have chosen the discounted, non-refundable rate (rather than the standard rate) for their booking, then the booking is considered to be ‘non-refundable’ – i.e. the client cannot amend a non-refundable Booking, and won’t receive a refund if they cancel it.

We strongly advise that you take out comprehensive travel insurance to cover cancellations. If you choose not to, then you accept responsibility for any loss that you may incur due to your cancellation.
